Interesting how things change in court.
Just this past March when the Army Corps of Engineers faced a report placing blame at their feet the Corps maintained it's not ALL our Fault as the levees were not their sole responsibility. From Fox News: "Army Corps of Engineers: We Aren't Only Ones at Fault for Levees in Katrina Disaster"
NEW ORLEANS — The Army Corps of Engineers disputed Thursday a state-commissioned report that said the agency was solely responsible for the decades of mistakes that led to the devastating floods after Hurricane Katrina.
The corps worked with local and state groups "throughout the planning, design and operation of hurricane protection in New Orleans" the agency said in a news release.
The point is that all levels of government are part of the team that is responsible for the flood protection of the New Orleans area," corps spokesman Vic Harris said. "No one entity can do this by themselves."
Via Harry Shearer we see that now that the Army Corps is embroiled in a class action lawsuit...Viola...those levees are ALL theirs....
The government's attorney, Robin Smith of the U.S. Department of Justice, said the corps is protected from such claims by the Flood Control Act of 1928, which states that projects built under that law have immunity from litigation.
"This notion that the structure of the flood protection system can be torn apart -- this part failed, not this part -- is a complete myth," Smith said. "The entire structure was one unified structure when it was in place on Aug. 29, 2005. Those structures that failed were federal structures through and through." (all emphasis mine)

Unfortunately, that is the law. Truth has no relevance. It is all a matter of coming up with a facetious argument that suits the current desire.
